By accessing the mobile application (henceforth ‘the Application’), which is owned, operated and managed by Central Warehousing Corporation (CWC), a Government of India enterprise, is one of the largest warehousing agencies in India. Acceptance of Terms of Use

If you do not agree to these terms, please do not install this Mobile Application. Please note that we may change the Terms of Use from time to time. Please review these terms periodically and if you do not agree to any changes made in the terms of use, please stop using the Application immediately. If you continue to use, it means that you accept the extant terms of use. In case of a discrepancy between the English version of these terms and any other language version, the English version will be considered as correct.

Registration, Data and Obligations

You agree that all information given by you is governed by our Privacy Policy, and you consent to all actions we take with respect to your information consistent with our Privacy Policy. We will use the data that you have submitted to provide customized services to you. We shall not be responsible in any manner whatsoever for any dispute for using this application, including but not limited to registration, or recording any of your information on the CWCWMS application or in the backend of such platforms. The Department may verify details furnished by you, and if any information furnished is found incorrect or misleading and if, in our opinion, you have violated any provision of these Terms of Use then we shall have the right to disable your access to the application. You shall indemnify and hold harmless the Department, its subsidiaries, affiliates and their respective directors, agents and employees, from any claims made by any third party or penalty imposed due to your breach of the Terms of Use or your violation of any law, rules or the rights of a third party. You hereby acknowledge that the Department or its affiliates, officers and representatives shall not be responsible for any costs, damages, liability, or other consequence of your use of the Application.

Rules for Submissions and Messages

You shall not (nor cause any third party to) use platforms like community chat, reviews, and other features to perform any illegal activities (including without limitation defaming, abusing, harassing, threatening, promoting racism, or otherwise violating legal rights, such as rights of privacy) or misrepresenting your affiliation with a person or entity, false marketing, or to submit false or misleading information. We do not control and are not responsible for the quality, safety, lawfulness, or availability of the information, products, or services offered for sale on the application or the ability of the suppliers to complete a sale, or the ability of buyers to complete a purchase. We reserve the right to deny access to users who do not submit the details as required. We reserve the right but do not assume the obligation to restrict or prohibit any user’s use of the Application if we believe that the user is violating any of the terms of use or the law.

Your Content

The Application enables you to add texts, photos, links, and files to share with others. All material that you upload, publish, or display to others via the Application will be referred to collectively as “Your Content.” Your Content is not confidential or proprietary. You grant and warrant that you have the right to grant us a non-exclusive, non-revocable, transferable, royalty-free right to use your content in any manner for any purpose related to e-governance or otherwise, including the right to translate, display, reproduce, modify, and distribute without any payment due to you. You acknowledge and agree that, as part of using the Application, Your Content may be viewed and shared by other users. Therefore, we advise you to use discretion in sharing your Content on the application, especially regarding sharing any personal information.

You shall not submit any information, or content that violates any other person’s ownership rights. Rights you acknowledge that:

We permit access to content that is protected by copyrights, trademarks and other intellectual and proprietary rights ("Rights") and except as expressly provided otherwise, terms of use and applicable copyright, trademark and other laws govern your use of the Application and its content. You may not reproduce or distribute the content in the Application without prior written consent of the Rights holder.

Third-Party Services

We do not endorse the advertisements on the Application placed by third parties. We make no representations as to the content, quality, suitability, functionality, or legality of any site to which we provide links, and you hereby waive any claim against us with respect to such sites. You may order services or merchandise through links on the Application from persons not affiliated with us. We make no warranties or representations about any goods or services those merchants provide. All matters concerning the merchandise or services, including but not limited to payment terms, warranties, guarantees, maintenance, and delivery, are solely between you and the merchants with whom you chose to do business. We will not be construed as a party to such transactions, whether we receive revenue or other remuneration in connection with the transaction. We shall not be liable for any direct or indirect costs or damages arising out of a transaction between you and any other person.

Disclaimer of Warranties

You agree that use of the Application is at your sole risk. The Application is provided on an "as is" basis. The Department, its affiliates, agents and licensors cannot and do not warrant the accuracy, completeness, merchantability, or fitness for a purpose of the information or applications available through the service and nor is the service guaranteed to be error-free, secure or continuously available. You also agree that your use of any information obtained through the Application is at your own risk. The application is provided with the understanding that neither Department nor its users, while such users are participating in the Application, are engaged in rendering legal, counselling, or other professional services. You are expected to make decisions based on your circumstances and risks.

Limitation of Liability

Under no circumstances shall we or our affiliates be liable to you or anyone else for any damages arising out of use of the services, including liability for consequential or incidental damages. You agree that the liability of The Department, its affiliates, agents and licensors, if any, arising out of any kind of legal claim related to the service shall not exceed the amount you paid for the use of the service.

Discontinuance, Modification Restrictions

We may discontinue, change, suspend, or restrict access to this service or any part of the service at any time without liability to you or any third party.

Applicable Law & Exclusive Jurisdiction

This application is controlled and operated by the Central Warehousing Corporation in India. Those who access the application from other locations do so on their own and are responsible for compliance with applicable local laws.

Privacy Policy and User Data

This privacy policy is governed by and is compliant with the information technology (reasonable security practices and procedures and sensitive personal data or information) rules 2011, which is designed to protect personal information of the end-user(s) of the services; and other applicable rules and regulations related to privacy. This privacy policy sets forth the modes of collection, use and disclosure of your information gathered on the application. It applies only to conidential information collected on the application.

The policy may change from time to time, so users are requested to check it periodically. By continuing to use the Application, you agree to it. If you do not agree to this privacy policy, please do not avail the Application.

This privacy policy applies to the user data collected by the Department viz., Name, Contact number, Email address, commodity, mobile phone information including contact numbers, SMS, and location data.

User Data

We shall use the user data in the following case:

i. For verifying your identity, eligibility, registration and to provide customized services. ii. For facilitating the services available on the application. iii. For e-governance related tasks. iv. For enabling communication with other users of the application. v. For sending communications and notifications.

Please get in touch with us if you object to any purpose of data processing. However, please note that if you object or withdraw consent to process data as above, we may discontinue your access to the services given through the Application.

Right to rectify

You have the right to rectify any inaccuracy or incompleteness in your personal data held by us. You can do the same by writing to us in the Help icon on the help page on wmshelpdesk@weexcel.in

Storage

We shall ensure that your confidential information is stored in our secure databases with restricted access. To protect your Personal Information, we have implemented adequate security technology and will update these measures as appropriate.

We may retain information about you in our databases for as long as your account is active or as needed to provide you services and in accordance with applicable laws. Our retention and use of your information will be as necessary to comply with our legal obligations, resolve disputes, and to enforce agreements. The retention period may extend beyond the end of your relationship with us, as required for us to have sufficient information to respond to any issues that may arise later or for our commercial records, to provide you services if you reopen your account. Please note that there will be a latency in deleting your information from our servers and backed-up or disaster recovery versions may exist even after deletion.

We will respond to your request about access to the information we collect about you within the timeframe required by applicable law. The following persons may have access to the user data:

Administrators: We may provide access to your information to our authorized administrators for e-Governance purposes, who are bound by confidentiality obligations towards the same.

Departmental Stakeholders: We may provide information we collect to our Departmental Stakeholders. For example, we may disclose Personal Information to our Departmental Stakeholders to respond to your requests for information or the services.

Service Providers: We may share your Personal Information with the service providers who work with us in connection with the operation of the Application, so long as such service providers are subject to restrictions of this Privacy Policy.

Legal and Regulatory Authorities: We may be required to disclose your Personal Information due to legal or regulatory requirements. In such instances, we reserve the right to disclose your Personal Information as required to comply with our legal obligations, including but not limited to complying with court orders, warrants, or discovery requests. We may also disclose your Personal information.

Notwithstanding anything mentioned hereinabove, the Department shall not be responsible for any additional information you may choose to provide directly to any service provider or any third party.

By the usage of the application you have consented or otherwise given us permission to share. We may share your information as below:

a) By aggregation or anonymization, so that it cannot reasonably be used to identify you; or b) With third party service providers who we use in delivering our services, including certain advertising, referral, operations, financial services, and technology services. c) If required by applicable law or legal process, or if we believe it is in accordance with applicable law or legal process. d)To protect the rights, property and safety of the Department, our users or the public, including, for example, in connection with court proceedings, or to detect or prevent criminal activity, fraud, misrepresentation, or to establish our rights or defend against legal claims; e) In connection with selling, merging, transferring, or reorganizing our business. f) With third parties to share your credit worthiness. g) With your consent: Other than as set out above, you will receive notice when information about you might go to third parties and you will have an opportunity to choose whether or not to share the information.

Termination

This User Agreement and the license rights granted hereunder shall remain in force unless terminated for any of the following reasons: (a) immediately for any unauthorized use by you (b) immediately if you assign or transfer (or attempt the same) any rights granted to you under this Agreement; (c) immediately, if you violate any of the terms and conditions of this User Agreement. Termination or cancellation of this Agreement shall not affect any right or relief to which The Company may be entitled, at law or in equity. Upon termination of this User Agreement, all rights granted to you will terminate and revert to The Company. Except as set forth herein, regardless of the reason for termination of this User Agreement, the fee charged, if any, for access to the Application is non-refundable.
